1. Terms & conditions introduction
1.1 We operate the website www.shopsharks.co.uk (the "Website"). We are Shop Sharks Ltd, a company registered in the United Kingdom. References to "we", "our", or "us" refer to Shop Sharks Ltd.
1.2 If you are a consumer, references to "you" refer to the individual using our website and purchasing the products listed on our site ("Products") for personal, non-commercial purposes.
1.3 These terms and conditions ("Terms") along with our Privacy Policy make up the agreement ("Agreement") under which we supply Products to you.
1.4 By creating an account with Shop Sharks and placing an order, you agree to be bound by these Terms. Users who register with us create an "Account" and become "Users". Even if you do not register, continued use of the Website confirms your acceptance of these Terms.
1.5 If you do not agree with any part of these Terms, please do not use this Website.
1.6 We may update these Terms at any time.
2. Placing an Order
2.1 A contract for purchase is created as follows:
You must create an account to place an order.
Orders are placed by clicking the confirmation button at checkout.
When you confirm your order, you agree to purchase the personalised product selected.
We will take payment at the time of order.
A confirmation email will be sent upon successful order placement, forming a contract between us.
You will also receive a dispatch confirmation email once your order has been shipped.
2.2 Orders may be declined for reasons including:
Out-of-stock items;
Payment authorisation failure;
Pricing or product description errors;
Breach of Terms;
Poor quality or unsupported images for personalisation;
Inappropriate or prohibited content (see Section 4.3);
Suspected fraudulent activity.
2.3 Orders for personalised products cannot be changed or cancelled once placed.
3. Product Descriptions and Pricing
3.1 We strive for accuracy but minor variations in colour, layout, and typeface may occur.
3.2 Product prices may change and we reserve this right.
3.3 If a price is displayed incorrectly and is clearly a mistake, we are not obliged to honour it.
3.4 Prices are shown in GBP and include VAT. Delivery charges are added at checkout.
3.5 International orders may be subject to additional customs duties or import taxes. These are not covered by Shop Sharks.
4. Personalised Products
4.1 It is your responsibility to ensure all personalised content is correct before submitting your order. We cannot edit or cancel once the order is placed.
4.2 Images must be in JPEG format and high resolution for best results. We cannot guarantee print quality from low-resolution files.
4.3 Content Guidelines: We do not allow content that:
Infringes copyrights or trademarks;
Violates confidentiality or other rights;
Breaks the law;
Is false, offensive, or misleading;
Impersonates others;
Shares personal data without consent;
Is obscene, discriminatory, or incites violence;
Harasses or distresses others;
Suggests endorsement by Shop Sharks;
Promotes illegal activities or phishing (for digital products).
5. Delivery
5.1 Delivery costs are shown separately at checkout.
5.2 Estimated delivery times are provided but are not guaranteed.
5.3 Delivery delays due to events beyond our control are not our responsibility (see Section 15).
5.4 Import duties and customs charges for international orders are the responsibility of the customer.
6. Changes and Cancellations
6.1 Orders for personalised products cannot be changed or cancelled once confirmed.
6.2 We are not responsible for errors caused by incorrect input from customers (e.g. spelling, image quality, delivery address).
7. Refunds
7.1 If your item is damaged or misprinted, you may request a refund or replacement within 7 days of receiving it.
7.2 Email us with your order number, description, and photo evidence.
7.3 If a refund is approved, you will receive a refund including delivery fees within 28 days.
7.4 If you opt for a reprint, we will resend the item free of charge.
7.5 We do not offer both a refund and a reprint.
7.6 Non-personalised items can be returned for a refund — see Section 8.
7.7 Perishable items are non-refundable.
8. Returns (Non-Personalised Products)
8.1 If your item arrives damaged, refer to Section 7.
8.2 You can return non-personalised items within 30 days for a full refund. Items must be unused and in original packaging.
8.3 Your statutory rights remain unaffected.
9. Payment
9.2 Total cost (including delivery) is shown at checkout and in your confirmation email.
9.3 Payment is taken at order confirmation.
9.4 By placing an order, you confirm that your payment details are valid and payment will be made.
9.5 Orders that cannot be fulfilled (see Section 2.2) will not be charged.
9.6 Confirmation emails include a simplified VAT receipt.
10. Privacy
10.1 We use your data in accordance with our Privacy Policy.
11. Intellectual Property
11.1 All content on our site is owned or licensed by Shop Sharks and may not be copied or reproduced without permission.
11.2 Unauthorised use may lead to legal action.
12. External Links
12.1 We are not responsible for content or services on websites linked from ours.
13. Liability
13.1 We are not liable for:
Loss of business or profits;
Data loss or corruption;
Indirect or consequential damages.
13.2 We do not exclude liability for death or personal injury due to our negligence.
14. Ownership and Risk
14.1 Risk passes to you upon delivery.
14.2 Ownership passes once full payment is received.
15. Events Beyond Our Control
15.1 We are not responsible for delays caused by factors outside our control.
15.2 This includes (but is not limited to): severe weather, strikes, pandemics, or transport issues.
16. Governing Law
16.1 These Terms are governed by English law and any disputes shall be resolved by the courts of England and Wales.
17. Customer Communication
17.1 We aim to treat all customers with respect and ask the same in return. Abusive language will not be tolerated and may result in blocked communication.
18. Photo Retention Policy
18.1 Photos uploaded for personalised products may be retained temporarily to complete your order or assist with reprints.
18.2 If a photo is uploaded but not used in an order or saved design, it will be deleted within 30 days.
18.3 If a photo is used in a saved design but not ordered, it will be deleted after 3 months of inactivity.
18.4 If a photo is used in a completed order, it will be retained for up to 2 years to allow for reprints, unless removed sooner by request.
18.5 You can request early deletion of your uploaded content at any time by contacting our support team.
18.6 All stored content is handled in accordance with our Privacy Policy and data security practices.
